I second this.  

While photoshop cs3 is not easy to install currently (there is a bug that
prevents the setup from installing), there are workarounds to get the setup
going so it might be time to start fixing photoshop itself.  

Note: I was able to install it using "winetricks msxml6 gdiplus gecko vcrun2005
ie6" and the attached patch (forward ported from the patch offered on
http://bugs.winehq.org/show_bug.cgi?id=18070) applied to
47ec8ab0f3fcd66e0a9b8000b0826066a7bdca8a.

Without the native gdiplus, the new CS3-style toolbars do not render at all. 
With it, things are much better.  The toolbars originally are rendered black,
though after clicking on them they show up correctly minus the z-order problem
mentioned by the original poster.  

I'm attaching a screenshot showing the problem.  Note how the image window is
overlapping with the rightmost panel.  Also, note the black rectangles to the
left of the right most panel and under the leftmost panel.
