This sounds like a duplicate of bug 22091.

Please note, that you can install the game (at least it works for me),
including the DX installation, then run the datasetup.exe (it's in the data
directory on the DVD) manually afterwards, patch the game to 1.02 and you
should be fine.

Though I'm using the game with the Gallium3D driver (r600g) and not the
proprietary one.
