I'm on a GeForce FX 5700, driver version 169.12.
The problem occurs for me not only in Max Payne 2, but also in FIFA 08; in
current git the solid color has indeed been replaced by the proper 3D graphics,
but the performance is very bad here as well.

Curiously, Max Payne 2 now crawls (several seconds per frame) even on a
"medium" postprocessing level - and in situations that had been running
perfectly for a long time (about the start of the 0.9 series, I guess).
