My patch was removing D3DFMT_A8B8G8R8 texture format support. This solved the
issue (when it was reproducible) and I verified that at least with some cards
this format is not supported on Windows 7. But if now there is no known app
depends on NOT supporting this format, I would not suggest removing it. Anyway
the decision to remove this format for d3d9 would probably need more testing
(at least it is not known to me how universally this format is unavailable) on
different hardware and Windows version.

So my understanding is that this patch is not needed (unless any new app
requiring that will be encountered) and this bug can be safely closed.
