after further research i found this bug:
https://bugs.winehq.org/show_bug.cgi?id=45938 which seemed comparable

and the solution is in fact to compile staging without the patch
"server-send_hardware_message"

https://github.com/wine-staging/wine-staging/tree/master/patches/server-send_hardware_message

fixes the problem in Mass Effect 3
