KERNEL: tolerate ioctl failure for Smartlink comm port

The program HyperTerminal is currently unable to use a 
SmartLink-provided port (a softmodem) because an ioctl used on the 
serial port is invalid for the terminal supplied by SmartLink. This 
patch allows HyperTerminal to work correctly.

Changelog:
* Tolerate ioctl failure in GetCommState() in order to be capable to use 
softmodems
