If its using any of the common licenses (GPL, LGPL, BSD, or even
[horror!] one of the Creative Commons licenses) there should be a copy
of the license in the download and every source file should mention the
license. The README usually mentions it too.

If there really is no license, ask the Darwine author about it and use
the license he prefers.
